Rather than accepting the decisions of the two highest courts in our state, Mr. Kobach is resorting to backroom attempts to change the law and shut the courts out of our government so he can have full, unchecked power.

The Kansas Supreme Court this week denied Attorney General Kris Kobach’s request to keep in place a district court order preventing transgender Kansans from getting driver’s licenses with accurate gender markers. Earlier this year, the Kansas Court of Appeals had issued a decision protecting transgender Kansans’ rights, which the attorney general had appealed. This week’s denial of that appeal means that the decision can go into effect Monday, October 6.

In a victory for transgender Kansans, a Kansas state appeals court has reversed a district court decision barring the Kansas government from making changes to gender markers on driver’s licenses.

Two transgender adolescents and their parents have filed a challenge in Kansas state court against SB 63, a law passed earlier this year prohibiting access to gender-affirming medical treatments for transgender people under 18.

We remain unconvinced that this legislature understands the real concerns and constitutional protections afforded to everyday Kansans, and their rush to push this government intrusion through demonstrates it all the more. This was an extremist, shameful attack on Kansans.

Following a veto from Governor Laura Kelly on Tuesday afternoon, the ACLU of Kansas is calling on the legislature to now sustain the governor’s veto and prevent SB 63 from becoming law.

Both houses of the Kansas Legislature have voted again this year’s session to pass an extreme bill that bans access to healthcare for transgender youth and that potentially censors a wide variety of conduct by state employees that could intrude into schools, therapist offices, and state agencies.

The Kansas Court of Appeals will consider whether Kansans should be able to change their gender markers on their driver’s licenses for the duration of litigation in Kansas v. Harper.
