To Mr. Kobach, the issuance of the rule is an opportunity to advance his extreme agenda — but for Kansans who face sexual harassment and violence, this is about protecting their right to be safe in leaving their rooms, going to class, or getting help they need.

Blocking SB233 is a victory for transgender kids, their families, and advocates across the state. We are thrilled and relieved, and we remain in awe of this session’s incredible showing of strength, resilience, and solidarity in this community of transgender Kansans and allies.

A number of organizations, including the ACLU of Kansas, Equality Kansas, Kansas Interfaith Action, Loud Light, Mainstream, Planned Parenthood Great Plains Votes, and Trust Women Foundation are warning legislators that the bill’s extreme reach could have unintended consequences.

Transgender Kansans represented by the ACLU of Kansas and the ACLU have filed a notice of appeal in Kansas v. Harper, the ongoing litigation over gender marker changes on Kansas driver’s licenses.

Notably absent from Attorney General Kobach's letter to school districts about their policies protecting transgender students is a meaningful legal analysis, so we are glad to provide one.

“The policy change being pursued by the Attorney General is a degrading and discriminatory affront to transgender Kansans’ liberty and their safety, and the voices of transgender Kansans in defense of their personhood shall not and will not be silenced.”

While the court’s decision today is disappointing and undoubtedly leaves transgender Kansans in fear, we want to make clear that this decision is not the final decision in the case. This order is only in effect until a hearing can be held on this matter where fuller arguments will be considered.
